Which e-bikes are illegal in California?

  • Motor over 750 W1
  • Any vehicle the maker intends to be modifiable beyond 20 mph on motor power alone or beyond 750 W can't be sold or labelled as an e-bike1
  • A bike modified beyond 20 mph on motor alone, beyond 750 W, or with its pedals removed is no longer an e-bike1
  • Sold new without the accredited-lab battery mark (from 1 Jan 2026)3

Those vehicles fall outside the e-bike rules entirely, which in practice means motor-vehicle rules apply.

What's changed, and what's coming

1 Jan 2025SB 1271 took effect: bikes designed to be 'unlockable' past 20 mph on motor power, or past 750 W, can no longer be advertised or sold as e-bikes1.
1 Jan 2026Battery testing and lab-mark rule for new e-bikes came into force3.
1 Jan 2028The same battery rule applies to rental e-bikes4.

Which e-bikes catch fire?

California's battery rule only counts a test done by an accredited lab, and the bike must carry that lab's mark and the standard it was tested to3.

US recalls are published by the Consumer Product Safety Commission. Every brand in the table above is searched there, and anything it finds is listed on the brand's page5.

Fire-related records for the brands on this page:

  • Jetson 42-Volt Rogue self-balancing scooter (a hoverboard, not an e-bike), CPSC recall, 30 Mar 2023: the regulator recorded “fire hazard”. The lithium-ion battery packs could overheat. About 53,000 were recalled; the CPSC records that a fire in Hellertown, Pennsylvania in April 2022, which the fire marshal traced to a Rogue, killed two sisters48.
  • Vivi 36 V batteries supplied with older models (C26, MT20, M026SH, H6 and others), CPSC recall, 17 Jul 2025: the regulator recorded “fire and burn hazards”. The lithium-ion batteries could overheat. About 24,000 were recalled; VIVI had 14 reports of overheating, including three fires, and no injuries. The recall lists the affected e-bike and battery model numbers49.

Other regulator records

Safety reports and recalls for the brands on this page that aren't about fire:

  • Aventon Sinch.2 (no longer listed), CPSC recall, 4 Jan 2024: the regulator recorded “crash and injury hazards”. The Class 2 Sinch.2 folding e-bike could accelerate unexpectedly. About 2,300 were sold50.
  • Brompton T Line (the non-electric titanium bike), CPSC recall, 1 Aug 2024: the regulator recorded “fall hazard”. Steerer clamp bolts that weren't tightened enough could let the handlebar and front wheel lose alignment. It covers the Blasted Titanium T Line, about 1,080 sold in the US51.
  • Brompton Electric M2L, H2L, M6L and H6L (previous generation), CPSC recall, 9 Jun 2022: the regulator recorded “crash and injury hazards”. The mudguard sat too close to the front wheel, which could lock if something got caught between them. About 2,230 were sold in the US52.
  • Brompton Electric (previous generation, 2021 recall), CPSC recall, 21 Apr 2021: the regulator recorded “fall and injury hazards”. A software fault could keep the motor assisting when the rider wasn't pedalling. About 600 were sold in the US53.
  • Brompton bicycles made April 2014 to May 2017 (non-electric), CPSC recall, 21 Dec 2017: the regulator recorded “fall hazard”. The bottom bracket could break during use. About 8,400 were sold in the US54.
  • Rad Power Bikes RadWagon 4, CPSC recall, about 29,300 bikes, 3 Nov 2022: the regulator recorded “fall and crash hazards”. A misaligned rim strip could pop the inner tube and damage the tyre, and the ribbed-sidewall tyres could go flat; owners were offered a free repair55.
  • Jetson Nova and Star 3-wheel children's kick scooters (not e-bikes), CPSC recall, 1 Jun 2023: the regulator recorded “fall hazard”. The rear wheel could loosen or fall off. About 15,300 were recalled56.
  • Lectric XP 3.0 and XP Step-Thru 3.0 (previous generation), CPSC recall alert, 7 Sept 2023: the regulator recorded “crash and injury hazards”. The mechanical disc brake calipers could fail. About 45,000 bikes were covered; Lectric had four reports of lost braking, including two injuries57.
  • Super73 Z Miami SE, Z Adventure Series, CPSC recall, 20 Feb 2025: the regulator recorded “crash and injury hazards”. The retaining pin in the disc brake calipers could loosen and fall out, causing brake failure. It covers model year 2024 Z Miami SE and Z Adventure Core bikes, about 1,400 in the US; Super73 had 21 reports and one minor injury58.
  • Decathlon Van Rysel GRVL AF gravel bikes (non-electric), CPSC recall, 8 Oct 2026: the regulator recorded “crash hazard”. The front lock nut could loosen and let the front wheel dislodge. About 1,150 were sold in the US; the electric E-GRVL AF is a different model59.

What this page is, and isn't

This page is an analysis of published documents: the law and official guidance from the California Vehicle Code and Health and Safety Code, and what each brand publishes about its own bikes. It is not legal advice, and it is not an opinion on any brand or bike. Everything was checked on 23 October 2026, and every fact links to its source.

✓ Legal as listed means the brand's own published specification for that market sits inside the legal limits. It does not mean I have tested the bike or seen its certificates, unless the page says so. ? Can't confirm means a figure the law depends on isn't published, so it can't be confirmed either way. Paperwork counts which documents are public. It is not a safety rating.

Laws change, and cities and councils can add their own rules. Before you ride, check the official source.

Corrections. If you make one of these bikes and something here is wrong, send the document to hello@velorution.com. I'll re-check it within five working days and update the page.

How this site earns. Some “Visit store” buttons are affiliate links. If you buy, Velorution may earn a commission at no cost to you. A brand can't buy a better mark. A store button only appears where a bike is marked ✓, and never on a model with a regulator safety record from the last three years.
